Art Viva Terms of Trade for wholesale customers.

 

 

The following Terms of Trade apply to all products provided by Art Viva.  Please make sure you choose carefully as all products are sold relative to the following terms:

1. Art Viva operates relative to the trading laws of Tasmania, Australia.
2. Art Viva products are only available to genuine retailers with a current ABN.
3. Art Viva reserves the right to decline supply to any person or business that it deems to be unsuitable as a retailer or distributor of Art Viva products.
4. The Art Viva branding is not to be removed from the products supplied unless through negotiation with Art Viva.
5. The Art Viva name is to be recognised on all webpage marketing.
6. Art Viva products are not to be retailed through any e-commerce medium, eg. eBay, etsy or local markets.
7. Art Viva's return policy on goods that are found to have manufacturing faults and are accepted by Art Viva, is to exchange for goods of equal value or to provide a credit towards the purchase of other goods at Art Viva's discretion for a period of 30 days of receipt.  Cost of returning faulty items for claim is to be paid by the customer.
8. Art Viva will not accept returns for any other reason other than for faulty manufacturing.
9. Any unauthorised returned goods will not be accepted.
10. Art Viva will not be liable for any goods returned that are found by to be free of faults or goods with physical damage; ie damage caused by improper use or damage in transit.
11. Art Viva will not be responsible for goods lost or damaged in transit.
12. Art Viva will take as much reasonably practicable care for the preparation and packaging of goods for transit.
13. All orders are subject to acceptance and confirmation by Art Viva.
14. Terms and conditions of payment for the goods are strictly Payment Before Dispatch, unless otherwise negotiated with Art Viva.
15. The title of goods shall not pass to the buyer until full payment has been received and payments are cleared by Art Viva.
16. Art Viva will not deliver to third party addresses unless otherwise agreed.
17. Customers are responsible for any costs incurred by unclaimed goods or refused shipments.
18. Customers must ensure that someone is available at the delivery address to accept the goods if signature is required on delivery by postal service.
19. Art Viva will use its best efforts to ensure that delivery is timely but cannot be held liable for any delayed or lost goods.
20. Art Viva's liability for the goods ceases at the point of dispatch.
